4. Client Projects & Deliverables
For client projects:
- Ownership of deliverables will be defined in the project agreement or contract
- BitNest retains ownership of pre-existing tools, frameworks, libraries, and intellectual property
- Custom code developed for clients is transferred according to contractual terms
- Clients are responsible for providing accurate requirements and timely feedback
Any changes beyond the agreed scope may require additional fees or timeline adjustments.
5. Payments & Billing
- Fees, payment schedules, and invoicing terms are defined in project agreements
- Payments must be made on time as agreed
- Late payments may result in project delays or service suspension
- All fees are non-refundable unless explicitly stated otherwise
BitNest reserves the right to revise pricing with prior notice.
6. Confidentiality
Both parties agree to maintain confidentiality of all proprietary, technical, and business information exchanged during the engagement. Confidential information must not be disclosed to third parties without prior written consent, except where required by law.
7. Data Protection & Privacy
Your use of BitNest services is also governed by our Privacy Policy, which explains how we collect, use, and protect personal data.
Clients retain ownership of their data. BitNest will process data only for agreed purposes and in compliance with applicable data protection laws.
8. AI, Automation & Data Usage
For AI, automation, and machine learning services:
- Client data is used solely for project-specific purposes
- Data is not reused, shared, or resold without written permission
- Model training and deployment follow contractual and ethical guidelines
- BitNest does not claim ownership of client datasets
9. Third-Party Services
Our services may integrate with third-party tools, APIs, or platforms. BitNest is not responsible for third-party services, availability, or policies. Use of third-party services is subject to their own terms.
10. Warranties Disclaimer
BitNest services are provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that services will be uninterrupted, error-free, or meet all expectations beyond agreed specifications.
11. Limitation of Liability
To the maximum extent permitted by law, BitNest shall not be liable for:
- Indirect, incidental, or consequential damages
- Loss of profits, data, or business opportunities
- Delays caused by third parties or force majeure events
Total liability shall not exceed the amount paid for services during the preceding six months.
12. Indemnification
You agree to indemnify and hold harmless BitNest from any claims, damages, or expenses arising from your misuse of services, violation of these Terms, or infringement of third-party rights.
13. Termination
Either party may terminate services in accordance with the terms outlined in the project agreement. BitNest reserves the right to terminate access immediately for violations of these Terms or applicable laws.
14. Governing Law
These Terms shall be governed by and interpreted in accordance with the laws of Pakistan, without regard to conflict of law principles.
15. Changes to Terms
BitNest may update these Terms at any time. Changes will be posted on this page with an updated effective date. Continued use of services constitutes acceptance of the revised Terms.
